Welcome to MortgageeClauses.com (the Service), operated by Nymble Digital LLC (Company, we, us, or our). By accessing or using the Service, creating an account, or accepting these Terms of Service (Terms), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
These Terms apply to business and professional use of the Service. The Service is not intended for consumer personal, household, or family purposes.
MortgageeClauses.com provides a searchable database of mortgagee clause and related lender or servicer information for insurance professionals, mortgage industry participants, and related businesses. The Service may include lender names, clause text, mailing addresses, contact information, verification portal links, verification status indicators, and related data (collectively, Content).
We may add, change, or remove features at any time. Certain features may require a paid subscription.
You must be at least 18 years of age and able to form a binding contract to use the Service. You represent that you are using the Service for legitimate business or professional purposes (B2B use), not for personal, household, or consumer purposes.
If you use the Service on behalf of a company, agency, team, or other organization, you represent that you have authority to bind that organization to these Terms. Team and Agency account administrators are responsible for ensuring that all users they invite comply with these Terms and that seat limits and domain rules are respected.
To access certain features, you must create an account with accurate, current, and complete information and keep it updated. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at support@mortgageeclauses.com of any unauthorized use.
The account owner or designated administrator manages invitations, seat allocation, and billing. Actions taken by an administrator bind the organization, including acceptance of these Terms, payment authorizations, and use of the Service by invited users.
The Service offers public lender directory pages (no account required), a 30-day trial for new accounts, and paid Plus, Team, Agency, and Enterprise tiers (where available). Paid plans are billed monthly or annually as selected at checkout and automatically renew at the then-applicable rate for that plan and billing interval unless you cancel before the renewal date.
New paid subscriptions include a 30-day money-back guarantee on the first charge, as described on our Refunds page. Refund eligibility, exclusions, and process are governed by that page and these Terms.
We may change standard (non-founding) pricing with at least 30 days’ notice to existing subscribers on standard rates before the change applies to a renewal.
We may offer founding annual subscriptions at discounted rates (currently Plus $149/year, Team $390/year, and Agency $990/year). These are a founding member rate, locked for life on the subscriber’s plan tier for as long as that subscription remains active and in good standing.
The lock applies to the tier you subscribe to and the features included in that tier at signup, plus ongoing improvements we make to those existing features. On founding Team annual plans, optional extra seats billed on the same subscription stay at the founding extra-seat rate (currently $78/year per seat) while the subscription remains active and in good standing. It does not entitle you to every product or capability we may introduce later. Major new products or add-ons (for example roadmap items such as flood, lender-placed insurance (LPI), or loss draft tools) may be offered separately or in higher tiers at then-current pricing. Custom Enterprise API access is offered separately under Enterprise agreements. Where we offer early access or a member discount to founding subscribers, we will describe it at launch; we do not promise a specific discount amount.
The lock ends if you cancel, or if the subscription lapses past any applicable grace period for failed payment. If you upgrade or downgrade tiers, your rate moves to that tier’s founding annual rate if founding pricing is still available for that tier; otherwise then-current standard pricing applies. Founding annual checkout is available through 10/31/2026 at 11:59 PM Eastern Time.
You may cancel at any time through your account dashboard or the Stripe customer billing portal. Cancellation stops future charges and takes effect at the end of the current billing period. Except as stated on our Refunds page (including the first-charge money-back guarantee), no partial refunds are provided for unused time in a billing period.
If a renewal charge fails (by card or bank debit), Stripe may retry the payment method on file over a reasonable period, including through Smart Retries. While retries are in progress, you may retain paid access for a limited time. If payment still cannot be collected and the subscription becomes past due beyond our grace period, unpaid, or canceled, we suspend paid access (clause text, addresses, contacts, and other gated features) until you subscribe again and payment succeeds. You generally retain your account and profile data.
If you choose ACH debit, US bank account debit, or similar bank payment methods at checkout (processed by Stripe, Inc. and its partners), you authorize us and Stripe to electronically debit your designated bank account for subscription fees, taxes, add-on seats, and other charges you incur, including automatic renewal charges, in accordance with your selected plan and these Terms.
By providing bank account information and confirming payment, you represent that you are authorized to debit that account, that the information is accurate, and that you agree to Stripe’s applicable terms and payment mandate (including NACHA rules where applicable). You may receive a copy of or reference to the debit authorization through Stripe’s checkout or customer portal.
Returned payments: If a debit is returned, rejected, or reversed (for example, for insufficient funds or a stop payment), we may charge a $15 returned payment fee (or the maximum permitted by law), suspend or terminate access, and pursue collection of amounts owed. You remain responsible for all charges until cancellation.
Revocation: You may revoke authorization by canceling your subscription and removing the bank payment method in the Stripe customer portal, and/or by contacting your bank according to its procedures. Revocation may not affect debits already processing. We may suspend or terminate accounts associated with reversals, chargebacks, or abuse of bank payments.
Card payments remain subject to Stripe’s card network rules; this Section applies to bank debits you authorize through the Service.
New accounts may start a 30-day trial with no payment method required. During the trial you may view full clause details for up to three (3) unique lenders. When the trial ends or you reach the clause cap, you must subscribe to a paid plan to continue viewing clause text, mailing addresses, phone and email contacts, verification sources, and related gated Content.
Without signing in, you may browse our public lender directory pages, which show lender name, city, state, category or type, and high-level status. Clause text, addresses, contacts, and sources require an active trial or paid subscription (and acceptance of these Terms where applicable).
We may change trial length or limits with notice where required by law; material reductions apply only to new trials unless otherwise stated.
You consent to receive electronic communications from us (including email, in-app notices, and transactional messages) and agree that electronic signatures and click-through acceptances (including accepting these Terms, authorizing payments, and using the Service) have the same legal effect as handwritten signatures where permitted by law, including the Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state analogues.
You may withdraw consent to non-required marketing emails using unsubscribe links; transactional and legal notices may still be sent while you have an account.
You agree not to, and not to assist others to:
We may investigate violations and cooperate with law enforcement. Violations may result in immediate suspension or termination.
The Service provides reference information only. We are not an insurance company, producer, adjuster, law firm, financial advisor, or mortgage lender or servicer. Nothing on the Service is insurance, legal, tax, or financial advice. You are solely responsible for compliance with your licenses, carrier guidelines, lender requirements, and applicable law.
We do not act as your agent or on behalf of any lender, servicer, insurer, or government entity. Links to third-party verification portals or websites do not create an agency relationship.
We work to maintain a useful, professionally curated database, but Content may be incomplete, outdated, or incorrect. Mortgagee clauses change due to mergers, acquisitions, servicing transfers, and policy updates.
You must independently verify all clause wording, addresses, contacts, and portal requirements with the applicable lender, servicer, insurer, or official source before relying on them for policy issuance, endorsements, closings, claims, or compliance. The Service is a reference tool, not a substitute for confirmation with the counterparty.
We disclaim liability for errors, omissions, or reliance on Content, including entries marked Verified or Pending Verification.
Users may submit new clauses, corrections, or updates. By submitting Content, you grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute the submission in connection with the Service and our business (including improving the database). You represent that your submission is accurate to the best of your knowledge, that you have the right to submit it, and that it does not infringe third-party rights or breach confidentiality owed to an employer or client.
We may review, edit, reject, or remove submissions at our discretion.

The MortgageeClauses.com name, logo, and related marks are trademarks of Nymble Digital LLC.
All data made available through the Service on MortgageeClauses.com — including lender and servicer records, mortgagee clause text, mailing and routing addresses, phone numbers, fax numbers, email contacts, portal links, verification sources, verification status and history, related metadata, and the compilation, database structure, selection, and arrangement of that information — is proprietary to MortgageeClauses.com and Nymble Digital LLC.
We treat this compilation and the underlying curated dataset as confidential business information and, where applicable, as a trade secret. Except for the limited license in these Terms, no ownership or other rights in the Content or database are transferred to you.
These Terms grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service and to view Content solely for your own internal business purposes in accordance with your plan and these Terms. You may not sublicense, assign, or transfer this license. No other rights are granted. You may not use our trademarks without prior written consent.
By signing up for the Service in any manner — including creating an account, starting a free trial, subscribing to any paid membership, or being invited as a team member to an organization’s account — you agree on behalf of yourself and, where applicable, the organization you represent that you will not:
This Section applies to all users with access under your account (including Team and Agency seats) and survives termination of your account or subscription with respect to Content you obtained while access was active.
We may enforce this Section in addition to Section 8 (Acceptable Use) and Section 17 (Suspension and Termination). Without limiting other remedies, if we reasonably believe you violated this Section we may:
Your obligations under this Section are in addition to, not in lieu of, the disclaimers and liability limits in Sections 18 and 19, and your indemnity in Section 20.
Custom API access for Enterprise customers is available today: integrations are built to your workflow under a separate written or click-through API or Enterprise agreement (not self-serve). Contact enterprise@mortgageeclauses.com or use our contact form. We do not publish public API pricing or endpoint catalogs on the marketing site.
Except as expressly authorized under your Enterprise agreement, unauthorized API use, scraping, and bulk downloading remain prohibited and may result in immediate termination and legal action.
Enterprise API customers agree to reasonable usage monitoring and audit (including review of logs, call volumes, and access patterns we maintain for the integration) as needed to confirm compliance with their API or Enterprise agreement and these Terms.
The Service may link to third-party websites, lender sites, verification portals, payment processors (including Stripe), and other services we do not control. We do not endorse and are not responsible for third-party content, availability, or privacy practices. Your use of third-party services is at your own risk and subject to their terms.
Our Privacy Policy explains how we collect, use, and protect personal information. By using the Service, you acknowledge that policy.
The Service is provided on a commercially reasonable efforts basis. We do not guarantee uninterrupted, timely, secure, or error-free operation. No uptime SLA or service-level credits apply unless expressly agreed in a separate signed Enterprise agreement.
Maintenance, outages, and third-party failures may affect access. We are not liable for downtime.
We may suspend or terminate your access immediately, with or without notice, if we reasonably believe you violated these Terms, pose a security or abuse risk, failed to pay amounts owed, or if required by law. Upon termination, your right to access the Service ceases; you remain liable for outstanding fees and chargebacks.
You may stop using the Service at any time. Sections that by their nature should survive (including payment obligations, acceptable use restrictions, intellectual property, disclaimers, limitations of liability, indemnity, dispute resolution, and general provisions) survive termination.
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that Content is accurate, complete, current, or suitable for any particular transaction; that Verified or Pending Verification labels meet your compliance needs; or that the Service will meet your requirements or be uninterrupted or secure.
Some jurisdictions do not allow certain disclaimers; in those jurisdictions, disclaimers apply to the fullest extent permitted.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
These limits apply to all theories of liability (contract, tort, negligence, strict liability, or otherwise). Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum permitted by law.
You agree to indemnify, defend, and hold harmless Nymble Digital LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service or Content; (b) your violation of these Terms; (c) your violation of law or third-party rights; (d) submissions you provide; or (e) use of your account by anyone you authorized or whose access you failed to secure.
Before starting arbitration or court action (except small claims as below), you agree to contact us at support@mortgageeclauses.com with a brief description of the dispute. We will try to resolve it informally within 30 days.
Except where prohibited by law, any claim or cause of action arising out of or related to the Service or these Terms must be filed within one (1) year after the claim accrued; otherwise it is permanently barred.
Except for the small claims carve-out below, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or Commercial Arbitration Rules if you use the Service primarily for business purposes, as determined by the AAA), as modified by this Section. The arbitration shall take place in Hillsborough County, Florida, or by video/telephone if the arbitrator permits. The arbitrator may award the same damages and relief a court could award on an individual basis.
Class and jury waiver: You and the Company agree that disputes will be resolved only on an individual basis. You waive any right to participate in a class, collective, consolidated, or representative action or trial by jury.
Opt-out: You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@mortgageeclauses.com with subject line “Arbitration Opt-Out,” your name, account email, and a clear statement that you opt out. If you opt out, the arbitration and class waiver in this Section do not apply to you; the governing law and venue provisions below still apply.
Small claims: Either party may bring an individual action in small claims court in Hillsborough County, Florida (or your county of residence if permitted), if the claim qualifies.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Subject to arbitration, the state and federal courts located in Hillsborough County, Florida have exclusive jurisdiction, and you consent to personal jurisdiction and venue there.
We may modify these Terms from time to time. When we make material changes, we will provide at least 30 days’ notice by email to the address on your account and/or by posting on the Service with an updated terms version and “Last updated” date before the changes take effect. Your continued use after the effective date constitutes acceptance. If you do not agree, cancel before the effective date.
The current terms version identifier is 2026-10-04.2.
Force majeure: We are not liable for delay or failure due to events beyond our reasonable control (including natural disasters, war, labor disputes, government action, internet or utility failures, cyberattacks, or pandemics).
Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
No waiver: Failure to enforce a provision is not a waiver of that or any other provision.
Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
Entire agreement: These Terms, the Privacy Policy, the Refunds page (for refund topics), and any plan-specific or Enterprise agreement you sign constitute the entire agreement regarding the Service and supersede prior understandings on that subject.
Survival: Provisions that by their nature should survive termination or expiration do survive.
Export and sanctions: You may not use the Service in violation of U.S. export control or economic sanctions laws. You represent you are not located in, or ordinarily resident in, a country or region subject to comprehensive U.S. sanctions, and are not a prohibited party.
Notices: We may provide notices to your account email. You are responsible for keeping your email current. Notices are deemed received when sent to that address, except where law requires otherwise.
We respect intellectual property rights. If you believe Content on the Service infringes your copyright, send a notice to support@mortgageeclauses.com with: (a) identification of the copyrighted work; (b) identification of the material and its location on the Service; (c) your contact information; (d) a statement of good-faith belief that use is not authorized; (e) a statement under penalty of perjury that the information is accurate and you are authorized to act for the copyright owner; and (f) your physical or electronic signature.
